Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the AIWritingPlus website and services (the "Service") operated by AIWritingPlus ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

AIWritingPlus provides a subscription-based software platform (SaaS) that offers access to over 100+ AI-powered tools, including text generators, image generators, code assistants, and more. Our service operates on a **"Bring Your Own Key" (BYOK)** model. This means that to use the AI generation features, you (the "User") must provide your own API keys from third-party AI providers  OpenAI.

2. User Accounts

To access the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Be solely responsible for all activity that occurs under your account.
  • Be at least 18 years old to use the Service.

3. Subscriptions, Payments, and Free Trials

a) Free Trial:

  • We offer a 7-day free trial for new users on select plans (e.g., "Pro Monthly").
  • To begin your free trial, you are required to provide your payment information via our third-party payment processor (Stripe).
  • You will not be charged during the 7-day free trial period.
  • IMPORTANT: At the end of your 7-day trial period, your trial will automatically convert into a paid subscription, and your provided payment method will be charged for the subscription fee unless you cancel *before* the trial period ends.
  • You can cancel your trial at any time from your account dashboard.

b) Subscription Fees:

We offer subscription plans (e.g., monthly, yearly) for a recurring fee. This fee grants you access to the AIWritingPlus software platform and its 100+ tools. This fee does *not* include any AI generation costs.

c) Billing:

All subscription payments are handled through a third-party payment processor (e.g., Stripe). You agree to provide current and accurate payment information. Following any applicable free trial, subscriptions will automatically renew unless canceled by you before the end of the current billing cycle.

d) Refunds:

  • All subscription fees are non-refundable. There are no refunds or credits for partially used periods.
  • If you cancel your free trial before it ends, you will not be charged.

4. The "Bring Your Own Key" (BYOK) Model

This section governs the core of our Service.

a) Third-Party API Keys: You are solely responsible for obtaining, securing, and maintaining your own API keys from third-party providers OpenAI. You are also responsible for any and all charges associated with your use of these third-party keys.

b) Third-Party Costs: AIWritingPlus is **not responsible** for any fees or charges you incur from third-party API providers. You are billed directly by those providers for your AI usage. Our subscription fee only covers access to our software platform.

c) Third-Party Terms: Your use of third-party API keys is subject to the terms and conditions of those third-party providers. You agree to comply with all terms set by OpenAIAPI provider you use with our Service.

d) Service Availability: Our Service's functionality depends on the availability of these third-party APIs. We are not liable if a third-party provider's API is unavailable, slow, or changes in a way that breaks our integration.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Create, upload, or transmit any content that is illegal, harmful, abusive, hateful, or discriminatory.
  • Violate any applicable laws or regulations.
  • Infringe on the intellectual property rights of others.
  • Reverse engineer, decompile, or attempt to extract the source code of our software.
  • Use the Service in any way that violates the terms of service of the third-party API providers (e.g., OpenAI's safety policy).

6. Intellectual Property

a) Our IP: All software, text, graphics, logos, and features of the AIWritingPlus platform are the exclusive property of AIWritingPlus and its licensors. Our subscription grants you a limited, non-exclusive, non-transferable license to use our platform.

b) Your IP: You retain all ownership, rights, and intellectual property to the content (text, images, code, etc.) that you generate using the Service. As stated in our Privacy Policy, we do not store or claim ownership of your generated content.

7. Disclaimers and Limitation of Liability

a) Disclaimer of Warranties: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties that the Service will be uninterrupted, error-free, or secure. We make no warranties regarding the accuracy, reliability, or completeness of any content generated by the AI models.

b) AI-Generated Content: You acknowledge that all AI-generated content is probabilistic and may contain errors, inaccuracies, or "hallucinations." You are solely responsible for reviewing, editing, and verifying all generated content for accuracy and appropriateness before use. AIWritingPlus is not liable for any damages resulting from the use of AI-generated content.

c) Limitation of Liability: To the fullest extent permitted by law, AIWritingPlus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service, your use of third-party API keys, or your reliance on AI-generated content.

8. Indemnification

You agree to defend, indemnify, and hold harmless AIWritingPlus and its employees, officers, and directors from and against any and all claims, damages, losses, and expenses (including attorneys' fees) arising from your use of the Service or your violation of these Terms.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms.

You may terminate your account at any time by canceling your subscription through your account settings.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date.
